ICE Detains Newark Mayor on Public Property, Raising Constitutional Alarms

On May 9, 2025, Newark Mayor Ras Baraka was arrested by federal agents at the Delaney Hall Immigration and Customs Enforcement (ICE) detention center in Newark, New Jersey. The arrest occurred during a protest against the facility’s reopening, which Baraka and other city officials argue lacks proper permits and violates local ordinances. Baraka, a Democratic gubernatorial candidate, has been a vocal critic of the detention center, operated by private prison company GEO Group under a 15-year, $1 billion contract with ICE.  

The incident escalated when Baraka attempted to join a scheduled tour of the facility alongside U.S. Representatives Robert Menendez, LaMonica McIver, and Bonnie Watson Coleman. Federal officials denied them entry, leading to a heated exchange. After returning to the public side of the gate, Baraka was approached by ICE agents and taken into custody, despite being outside the facility’s premises at the time. 

Acting U.S. Attorney for New Jersey, Alina Habba, stated that Baraka “committed trespass and ignored multiple warnings from Homeland Security Investigations to remove himself from the ICE detention center.” She emphasized that “no one is above the law.”  However, witnesses and activists present at the scene argue that Baraka had left the facility’s grounds and was on public property when arrested, raising concerns about the legality of the detention. 

Legal experts suggest that the arrest may constitute an overreach of federal authority, particularly if Baraka was on public property and not actively trespassing at the time of his detention. The Fourth Amendment protects individuals against unreasonable searches and seizures, and detaining a sitting mayor under these circumstances could be viewed as a violation of constitutional rights. Furthermore, the incident underscores tensions between federal immigration enforcement and local governance, especially in sanctuary cities like Newark that have policies limiting cooperation with ICE.

Governor Phil Murphy expressed outrage over the arrest, calling for Baraka’s immediate release and highlighting New Jersey’s 2021 law banning private immigration detention centers. Murphy noted that his administration is actively defending this law in court, emphasizing the state’s commitment to upholding civil liberties and local authority. 

The arrest of Mayor Baraka has sparked widespread criticism and calls for accountability. As the situation unfolds, it raises important questions about the balance of power between federal agencies and local governments, the protection of constitutional rights, and the role of private entities in immigration enforcement. The incident serves as a stark reminder of the ongoing debates surrounding immigration policy and the importance of safeguarding democratic principles.
